Preamble
These general terms of use govern the use of the website https://kelpom.fr ("The Site"), published by G. Obajtek ("The Editor").
The User is defined as any person accessing the Site by any means of connection and from any location.
The User agrees to read, accept, and comply with these general terms of use.
Intellectual Property
Kelpom.fr and its content (texts, logos, graphics, etc.) are protected by intellectual property law under the Intellectual Property Code.
The User undertakes not to directly or indirectly infringe the intellectual property rights of the Site's Editor.
Reproduction or use of the site or its content is only allowed after the express, written, and prior authorization of the Editor.
The databases of kelpom.fr are protected by the provisions of the law of July 1, 1998, transposing Directive 96/9 of March 11, 1996, relating to the legal protection of databases.
Editor's Responsibility
The information and content on the Site, including technical specifications, warranty, stolen or lost status, or any other information contained in the free Basic Report or paid Premium Reports (Light, Classic, and HD), are provided for informational purposes only and cannot be considered a commitment by the Editor.
The Editor is not responsible for the content and information transmitted by websites to which kelpom.fr refers through hyperlinks, as it is not the Editor of those sites.
The accuracy and reliability of the information contained on these third-party websites are not guaranteed by the Editor.
The User assumes personal responsibility for the information and content accessed on these third-party websites and acknowledges the need for caution and discernment in their use.
The User is solely responsible for the unauthorized use and reproduction of content belonging to third parties on the Site.
The Editor is not responsible for the unavailability of the Site, especially when it results from the unavailability of the internet, a failure of the User's computer system or network, or Site maintenance.
The Editor is not responsible for the possible presence of viruses on the Site.
User's Responsibility
By creating an account on Kelpom.fr (using the form or connecting via a Facebook account) and registering serial numbers and/or IMEI, the User agrees to comply with all the following General Terms of Use.
The User registering the serial number and/or IMEI of a device must be its legitimate owner.
Kelpom.fr reserves the right to request at any time that any User provide evidence (invoice, screenshot, photo, etc.) that they are indeed the legitimate owner of the concerned device.
Failing to provide the requested evidence, Kelpom may delete the device in question from the User's account.
Any User who does not comply with the Site's General Terms of Use will have their User account suspended.
As soon as the User sells or transfers a device for which they have registered the serial number and/or IMEI on Kelpom.fr, they agree to delete the device from their account or, if applicable, transfer the device to the new owner if they are also a Kelpom User.
Users who register serial numbers and/or IMEI that do not belong to them may face legal action.
Site Usage
Users can access up to 5 "Basic Reports" for serial numbers or IMEI of iPhones or iPads and 10 serial numbers or IMEI of any other device or brand per 24 hours.
The generation of Light, Classic, and HD Premium Reports begins immediately after the acceptance of payment by PayPal or Stripe. The generation of the Premium Report may take time, and the buyer can request to receive the report by email. It will be sent as soon as the information is gathered. Kelpom is not responsible if the email containing the Premium Report is not received due to an incorrect address or if the email is directed to the buyer's "spam" folder.
There is no obligation to create a User account to purchase a Premium Report. However, a Kelpom account is recommended to access the Premium Report later.
The purchase of a Premium Report entitles the User to reset the free search quota per 24 hours.
Unlike Premium Reports, creating a Kelpom account is necessary to purchase and use a "Premium FLEX" pack.
Since the available information may vary from one device to another, Kelpom cannot be held responsible for information considered missing by the User.
The buyer can request a refund for the Premium Report or "Premium FLEX" pack within 14 days under certain conditions.
Any refund request must be justified and will be examined as soon as possible.
If a technical problem prevents the display of the Premium Report, you will be contacted promptly by our support team.
Users undertake not to use unauthorized automated computer means (scraping, bots, scripts) to search for Apple serial numbers or IMEI directly on the kelpom.fr website. Automated access is permitted only through Kelpom's official API and MCP server, as described in the "API & MCP Access" section below and subject to any applicable rate limits.
Any User using unauthorized automated techniques will be blacklisted, and, if applicable, their User account will be suspended immediately.
API & MCP Access
Kelpom provides programmatic access to certain device-identification services through its official API and through an MCP (Model Context Protocol) server, including a free tool that identifies a device's model, brand and model number from its IMEI, usable by AI assistants that support the protocol.
Use of the API and MCP server is subject to these Terms of Use and to any rate limits, quotas or fair-use restrictions that Kelpom may apply. The data returned is provided for informational purposes only, "as is", without any guarantee of accuracy or completeness.
Users and connecting applications undertake not to abuse this access, in particular not to overload the service, circumvent rate limits, or resell or redistribute the data as a competing service. Kelpom may modify, restrict or discontinue API and MCP access at any time, without notice.
Where the service is reached through a third-party AI assistant, an anonymized identifier provided by that assistant may be processed solely to enforce rate limits, as described in our AI App Privacy Policy.
Payment Terms
Kelpom.fr uses the services of Paypal and Stripe to receive payments.
Kelpom never has access to the data of the card used during payment at any time.
Opposability
The User accepts these general terms of use by simply accessing kelpom.fr.
The version of the general terms of use applicable to the User is the one present on the Site when the User connects to the Site.
It prevails over any previous version and any paper version of the general terms of use.
The Site Editor may modify these general terms of use at any time.
The User therefore undertakes to read them in full before each access to the Site.
These general terms of use are proposed in the French language.
Applicable Law - Competent Jurisdiction
These general terms of use are governed by French law.
In the event of a dispute, French courts have sole jurisdiction.
